General Terms and Conditions
These General Terms and Conditions (“GTC”) apply to the online shop www.fahnag.ch.
1. Scope and supplier
1.1 These GTC apply to all orders placed through the online shop www.fahnag.ch and to all deliveries and services provided by Schweizer Fahnenmanufaktur AG, Fahnag brand, Gewerbe 2, 6025 Neudorf, Switzerland, telephone +41 41 630 35 53, info@fahnag.ch, VAT no. CHE-102.518.768 MWST (“Fahnag” or “we”).
1.2 The GTC apply in the version published at the time of the order. By submitting an order, the customer accepts them.
1.3 Differing or conflicting terms of the customer, in particular purchasing conditions, apply only if we have agreed to them in writing.
1.4 Individual agreements, written quotations and order confirmations take precedence over these GTC.
2. Conclusion of contract
2.1 The presentation of products in the online shop is not a binding offer but a non-binding invitation to order.
2.2 By submitting an order the customer makes a binding offer to conclude a contract of sale. Receipt of the order is confirmed automatically by e-mail; this acknowledgement of receipt does not yet constitute acceptance.
2.3 The contract is concluded upon our order confirmation or upon delivery of the goods.
2.4 Items marked “On request” in the shop cannot be ordered directly. We prepare an individual quotation for them on request.
2.5 We reserve the right to refuse orders without giving reasons, in particular in the case of obvious pricing or display errors, lack of availability or justified doubts as to solvency.
3. Prices and value added tax
3.1 The prices displayed in the shop at the time of the order, in Swiss francs (CHF), are decisive.
3.2 The prices shown are exclusive of value added tax, currently 8.1 %. Each item carries the note “price excl. VAT”. In the shopping cart, subtotal, value added tax and total amount are shown separately; the total amount payable including value added tax is therefore visible before the order is bindingly submitted. Value added tax is also shown separately on the invoice.
3.3 Shipping costs are not included in the prices and are shown separately during the ordering process before the order is bindingly submitted (see clause 4).
3.4 For custom-made items, the price stated in the written quotation applies.
4. Delivery and shipping costs
4.1 We deliver to Switzerland and Liechtenstein. Deliveries abroad are made only by individual arrangement; in that case customs duties, import taxes and fees are borne by the customer.
4.2 Shipping costs depend on the weight and volume of the consignment. The following rates apply:

The exact amount is calculated during the ordering process and shown before the order is bindingly submitted.
4.3 Delivery periods are guide values and not fixed dates unless expressly agreed otherwise in writing. We usually ship stock items within 1 to 3 working days. Custom-made items and flagpoles have longer delivery periods, which we state in the order confirmation.
4.4 Partial deliveries are permitted and do not entitle the customer to refuse the consignment.
4.5 Benefit and risk pass to the customer when the goods are handed over to the carrier. Transport damage must be reported to us without delay and notified to the carrier.
4.6 If delivery is delayed for reasons beyond our control — in particular force majeure, supply shortages at our suppliers, operational disruptions or official measures — the delivery period is extended accordingly. Claims for damages due to late delivery are excluded unless we are guilty of intent or gross negligence.
5. Terms of payment
5.1 Purchase on account is available in the online shop.
5.2 Invoices are payable without deduction within 30 days of the invoice date. For payment within 10 days we grant a 2 % discount.
5.3 After the payment period has expired without payment, the customer is in default without a reminder. From the onset of default, default interest of 5 % per annum is owed (art. 104 para. 1 CO). For each reminder from the second onwards we charge a processing fee of CHF 20.00.
5.4 For first orders, larger orders and custom-made items we reserve the right to require advance payment or a deposit.
5.5 Set-off of claims of the customer against our claims is excluded unless the counterclaim is acknowledged or has been established by a court.
6. Retention of title
The goods delivered remain our property until payment has been made in full. We are entitled to have the retention of title registered at the customer’s domicile or registered office (art. 715 CC). The customer undertakes to cooperate in such registration.
7. Custom-made items, artwork and third-party rights
7.1 Flags produced according to the customer’s template, design or specification — in particular with a coat of arms, logo, text or the customer’s own motif — are deemed to be custom-made items.
7.2 The customer provides the artwork in a suitable form and is responsible for the accuracy and completeness of the data supplied. Work we have to carry out to make the data ready for production is charged on a time and material basis unless agreed otherwise.
7.3 Before production we submit a proof for approval. With the approval the customer assumes responsibility for content, spelling, choice of colours and dimensions. After approval has been given, changes are possible only against reimbursement of costs.
7.4 The customer warrants that they hold all necessary rights in the templates supplied and that their use does not infringe the rights of third parties, in particular trademark, copyright, personality or heraldic rights. The customer indemnifies us in full against claims by third parties.
7.5 We expressly draw attention to the Swiss Coat of Arms Protection Act: the Swiss coat of arms and the coats of arms of the cantons, districts and municipalities may in principle be used only by the public body concerned. The flags of the Confederation, the cantons and the municipalities, on the other hand — that is, the Swiss cross on a square field and the cantonal flags — may be used by anyone. We may refuse orders that exceed this limit.
7.6 Custom-made items are excluded from the right of return under clause 10.
8. Colour, dimensional and material tolerances
8.1 Flags are textile products. Dimensional deviations of up to 3 % are possible for production reasons and do not constitute a defect.
8.2 In digital and screen printing, colour deviations from screen displays, printouts and earlier deliveries cannot be entirely avoided for technical reasons. An exact match with a Pantone or other colour guide cannot be warranted; we work with the closest possible approximation. Such deviations do not constitute a defect.
8.3 In the case of repeat orders, visible deviations from the first delivery may occur due to different fabric and dye batches.
8.4 With through-dyed and printed fabrics, a weakened show-through of the motif on the reverse is inherent in the material and does not constitute a defect.
9. Inspection, notice of defects and warranty
9.1 The customer must inspect the goods immediately upon receipt. Obvious defects must be notified to us in writing within 7 days of receipt, hidden defects immediately upon discovery (art. 201 CO). If notification is omitted, the goods are deemed to be approved.
9.2 No warranty on flags. Flags are textile wear parts. In use they are permanently exposed to wind, sun, rain, frost and airborne pollutants; fraying at the fly end, loss of colour and material fatigue are the inherent consequence of this and are by their nature not foreseeable. We therefore provide no warranty on flags.
Towards customers who make the purchase in the course of their professional or commercial activity, the warranty for flags is excluded in full (art. 199 CO).
Towards consumers, the mandatory statutory warranty remains reserved for defects that were already present at the time of delivery — such as a sewing fault, a faulty print or an incorrect execution. Its limitation period of two years cannot be shortened under art. 210 para. 4 CO.
9.3 What is not a defect. A flag is intended to be moved in the open air. The changes that arise in the process are inherent wear and tear and not defects. No minimum durability is warranted; the service life that can be achieved depends decisively on the location, on wind exposure and on care. In particular, the following do not constitute a defect:
Use and weather
- Fraying, tearing and unravelling of the fly end, the outer edge and the hems caused by movement in the wind — this is the most frequent and normal sign of wear;
- Loss of colour, fading, yellowing and uneven bleaching caused by sunlight, UV radiation and weather;
- Material fatigue, thinning of the fabric, loss of tear strength as well as distortion, waviness and deformation of the fabric in use;
- Loosening, opening or tearing of seams as a result of continuous wind load;
- Damage caused by storm, hail, lightning, snow and ice load, frost or other weather effects.
Mounting and surroundings
- Chafing and abrasion marks caused by contact with the flagpole, roof, wall, edges, trees, branches or other objects;
- Damage caused by improper mounting, fastening or handling, in particular by unsuitable fastening materials, excessively taut attachment or sharp-edged snap hooks;
- Tearing out and widening of eyelets and fastening points under excessive tensile load;
- Scorch and burn damage caused by flying sparks, fireworks, torches, candles or barbecues;
- Soiling by exhaust fumes, soot, dust, bird droppings, pollen or tree resin.
Handling, care and storage
- Damage caused by improper washing, cleaning, bleaching, ironing or drying and by the use of unsuitable cleaning agents;
- Musty stains, mould and odour caused by storing the flag in a damp or wet condition;
- Bleeding and rubbing off of colours when wet, in particular onto light-coloured adjacent fabrics;
- Changes caused by subsequent processing by third parties, such as shortening, re-sewing, re-hemming or overprinting.
External influence and tolerances
- Damage caused by vandalism, theft, animals or the action of third parties;
- The colour, dimensional and batch tolerances set out in clause 8;
- In the case of appliquéd, sewn-in and flamed flags, the minor variations between individual pieces that are typical of handwork.
9.4 Other products. The statutory warranty provisions apply to flagpoles, fittings and accessories. In the event of a justified and timely notice of defects, we provide, at our option, rectification or replacement. If this fails twice, the customer may demand a reduction of the purchase price or rescission of the contract. The limitation period is two years from delivery. More extensive guarantees for individual flagpole types remain reserved and are recorded in writing in the quotation.
9.5 Service life. The service life of a flag depends decisively on its location. We recommend taking flags in when a storm has been forecast and overnight, not leaving them permanently in the wind, and observing the care instructions. We re-finish frayed fly ends in our sewing atelier against reimbursement of costs — this extends the useful life considerably.
10. Right of return
10.1 Under Swiss law there is no statutory right of withdrawal for purchases made over the internet. We grant our customers a right of return voluntarily.
10.2 Unused stock goods may be returned within 7 days of receipt. The goods must be complete, unused, unwashed and in their original packaging.
10.3 A return must be registered in advance by e-mail to info@fahnag.ch. We do not accept unregistered or unfranked returns.
10.4 The cost and risk of the return are borne by the customer.
10.5 Excluded from the right of return are custom-made items under clause 7, flags with customer-specific printing as well as cut piece goods and special productions.
10.6 After receipt and inspection of the goods we refund the purchase price within 14 days by the original method of payment. The shipping costs of the original delivery are not refunded.
11. Liability
11.1 We are liable for damage caused by us intentionally or through gross negligence.
11.2 Liability for slight negligence and for auxiliary persons is excluded to the extent permitted by law. In particular, liability for indirect damage, consequential damage, loss of profit and business interruption is excluded.
11.3 Liability under the Product Liability Act and liability for personal injury remain reserved.
11.4 We give no warranty for uninterrupted availability of the online shop.
12. Data protection
12.1 We process personal data in accordance with the Swiss Data Protection Act and exclusively for the purpose of processing the order, customer support and compliance with statutory obligations.
12.2 Details are governed by our privacy policy, which forms an integral part of these GTC.
13. Applicable law and place of jurisdiction
13.1 All legal relationships between the customer and Fahnag are governed exclusively by Swiss law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
13.2 The exclusive place of jurisdiction is Neudorf LU, or the court having jurisdiction for the registered office of Schweizer Fahnenmanufaktur AG. Mandatory statutory places of jurisdiction, in particular the place of jurisdiction for consumers under art. 32 of the Swiss Civil Procedure Code, remain expressly reserved.
14. Final provisions
14.1 Should any provision of these GTC be invalid in whole or in part, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a valid one that comes closest to its economic purpose.
14.2 We reserve the right to amend these GTC at any time. The version published at the time of the order applies to that order.
